TCPA - Telephone Consumer Protection Act

The Telephone Consumer Protection Act (TCPA) regulates telemarketing calls, prerecorded marketing calls, auto-dialed calls, text messages, and faxes. The Federal Communications Commission (FCC) is empowered to issue rules and regulations implementing the TCPA.   Violations of the TCPA can lead to penalties that range from $500 to $1,500 per violation.  However, depending on the facts of the case, the repercussions of a single TCPA violation may not be enough to induce change in the way a violator conducts its business.  In certain cases, a class-action lawsuit may be the key to holding violators accountable.
