I drive for rideshare, and my income depends on staying active. Out of nowhere, my account got put “under review” and then deactivated because of something in my background check. Uber wouldn’t tell me much, just that it was based on my Checkr report.
I pulled the Checkr report from the portal and it’s showing a criminal case that isn’t mine. I disputed it immediately and uploaded my ID, but Checkr basically told me it could take up to 30 days.
In the meantime, I’m offline with no rides and no pay. I’m losing money every day because of someone else’s record. Can I sue Checkr under the FCRA for mixing me up with someone else and getting me deactivated?
Yes, if Checkr’s error costs you income, that may be a compensable FCRA violation. Checkr is required to:
- Use reasonable procedures to ensure accuracy.
- Match criminal records using multiple identifiers.
- Correct mistakes promptly when notified.
