How Long Do I Have to Sue Checkr?

I ran a background check through Checkr for a gig platform I was trying to join. The report showed a felony conviction - but my case was dismissed. Completely dismissed. I never had a conviction. They deactivated my account before I could even respond. Now I can't work. I'm trying to figure out if I can sue Checkr and how much time I have. Do I still have a case? Is there a deadline? I don't want to wait too long and lose my chance.

Answer from

When a background check report prepared by Checkr shows a dismissed charge as a felony conviction, that kind of error can carry real consequences - and it may implicate the Fair Credit Reporting Act (FCRA). Under the FCRA, consumer reporting agencies like Checkr are required to maintain reasonable procedures to ensure the accuracy of the information they report. A dismissed case appearing as a felony conviction is not a minor clerical issue; it can cost someone a job, a gig platform account, or income they depend on. The FCRA generally gives consumers the right to dispute inaccurate information and to seek legal remedies when those rights are violated.

What to gather, request, and document:

  1. A copy of the background check report Checkr provided - request your full consumer file directly from Checkr
  2. Documentation showing the correct disposition of your case, such as court records or a dismissal order
  3. Any adverse action notice you received from the platform or employer that used the report
  4. Dates of all communications, disputes, or correspondence with Checkr or the platform
  5. Records of how the error affected you - income loss, account deactivation, or denied access to work

Timing matters under the FCRA. The statute of limitations can be as short as two years from the date you discovered the violation, or five years from when the violation occurred - whichever comes first. If you believe Checkr reported inaccurate information about you, consider reaching out to Consumer Attorneys as soon as possible. Our team can review your situation at no cost, help you understand your options, and explain what a Checkr Inc. lawsuit may involve for someone in your position. Preserving your documents now can make a significant difference later.
