Is There an Active Checkr Class Action Lawsuit?

I just got a notification that my gig work account was deactivated. The platform used Checkr for my background check. I looked at the report and it shows a misdemeanor listed as a felony - that is completely wrong. I never had a felony. Now I can't work, I can't pay my bills. Does this fall under a class action? Have other people had this happen with Checkr? I'm searching at midnight trying to figure out what my options are. Please - is there a Checkr class action lawsuit I can join right now?

Answer from

When a consumer reporting agency like Checkr reports a misdemeanor as a felony on a background check, the error can have immediate, devastating consequences, and gig account deactivation is one of the most common real-world outcomes. Under the Fair Credit Reporting Act (FCRA), consumer reporting agencies are required to maintain reasonable procedures to ensure the accuracy of the information they report. An inflated charge severity - a misdemeanor appearing as a felony - can represent a serious accuracy failure. Depending on the facts, this type of error may support individual FCRA claims or, if a pattern of similar errors exists, may be connected to broader litigation such as a Checkr class action lawsuit.

What to gather, request, and document:

  1. Obtain a full copy of the Checkr background check report that was used in the decision, including any dispute records or reinvestigation results.
  2. Document the exact error - note the actual charge, the charge as reported, and the date you first discovered the discrepancy.
  3. Preserve any written notice from the platform about your deactivation, including any pre-adverse action or adverse action letters.
  4. Note important dates, including when the background check was run, when you were notified, and when you first disputed or plan to dispute the error.
  5. Gather any official court records or case documents that show the correct charge classification.
  6. Record all communications with Checkr and the platform regarding the error or the deactivation.

Consumer Attorneys offers free case reviews for individuals who believe a background check error has harmed them. If you have been affected by a Checkr reporting error - whether or not you are aware of a broader Checkr class action lawsuit - your situation and your documents deserve a close look. FCRA claims are time-sensitive, so preserving records and acting promptly can matter. Reach out to discuss your options with an attorney who handles consumer reporting cases.
