What should I do if Checkr mixed me with someone else and Uber deactivated my account?

I've been driving for Uber for two years without any issues. Last week, I got a notification that my account was under review, and then suddenly I was deactivated. When I contacted Uber, they told me it was because of my background check through Checkr. I pulled my Checkr report and there's a criminal case on there that isn't mine. The person has a similar name but a completely different middle name and date of birth. I've never been arrested in my life. I disputed it immediately through Checkr's portal and uploaded my driver's license, but they said it could take 30 days. Meanwhile, I'm not making any money and my bills are piling up. This is my primary source of income and I need to get back online as soon as possible.

When Checkr reports someone else's criminal record on your background check and causes your Uber deactivation, that's a serious FCRA violation known as a mixed file error. Background screening companies must use reasonable procedures to ensure they're reporting accurate information that actually belongs to you.

Here's what you need to do immediately:

  • Save all documentation: Keep copies of your deactivation notice from Uber, your Checkr report showing the incorrect record, and any correspondence with Checkr about your dispute.
  • Dispute in writing: Even if you already submitted an online dispute, send a written dispute by certified mail to Checkr. Include your photo ID, a clear statement that the criminal record belongs to someone else (different middle name, DOB, etc.), and request an expedited investigation due to loss of income.
  • Document your financial losses: Keep records of your lost earnings from the time you were deactivated. This is important for any potential legal claim.
  • Contact us with your case details: Send us your Checkr report showing the mismatched record, your Uber deactivation notice, and proof of the identity differences. We can escalate your dispute immediately, demand the source records and matching basis Checkr used, and push for a corrected report to be sent to Uber quickly.

If Checkr's error has cost you income and they're taking 30 days to investigate while you can't work, you may have grounds for an FCRA claim for lost wages, emotional distress, and other damages. Under the FCRA, if we win your case, Checkr pays our legal fees, so there's no cost to you to get professional representation.

Don't wait 30 days while your income disappears. We can help you get back online and hold Checkr accountable for their mistake.
