Can I sue Uber if they won't reactivate my account even after my background check was corrected?

Three months ago, Uber deactivated my account because Checkr's background check had someone else's felony conviction on it. I immediately disputed it and after six weeks, Checkr finally admitted the mistake and sent Uber a corrected report showing I have no criminal record. I thought that would be the end of it, but Uber is still refusing to reactivate my account. Every time I contact support, they give me a different excuse - first they said they need to review it, then they said it's been escalated to a specialist, now they're just not responding at all. I've lost three months of income because of this error that wasn't even my fault, and even though it's been corrected, Uber won't let me back on the platform. Do I have any legal options here?

Yes, you may have legal options against both Checkr and Uber. Even though Checkr corrected their error, the damage was already done, and Uber's refusal to reactivate you after receiving the corrected report may violate your FCRA rights.

Under the FCRA, when a background check company corrects an error, they must send the corrected report to anyone who received the inaccurate version. You have the right to be made whole - not just to have your report corrected on paper, but to have the consequences of the error reversed.

Here's what you should do:

  • Document everything with Uber: Save every email, chat transcript, and phone call record showing you contacted Uber about reactivation after the correction. Their pattern of excuses and delays could constitute bad faith.
  • Confirm Checkr sent the correction: Get written confirmation from Checkr that they sent the corrected report to Uber and when they sent it. If they didn't properly notify Uber, that's an additional FCRA violation.
  • Calculate your total losses: Track all income you've lost since deactivation - not just the initial error period, but the ongoing losses from Uber's refusal to reactivate you.
  • Send a formal demand: Contact Uber in writing, documenting that Checkr corrected the error, demanding immediate reactivation, and stating you're preserving all legal rights.
